Wincek & DeRosa is dedicated to representing individuals and their families who have been injured or killed due to the negligence and misconduct of another person or entity. Originally established over fifty years ago, we have represented thousands of individuals who have suffered injuries or the wrongful death of a family member resulting from a motor vehicle accident, medical malpractice, employment hazards, defective product, premises defect, nursing home neglect, or other tragedy.

At Wincek & DeRosa we devote our time, energy and experience to every case irrespective of its size or complexity. We have worked extremely hard to gain a reputation with insurance companies and attorneys for being knowledgeable, aggressive and well prepared in our representation of our clients.

If you have suffered a personal injury, you may be entitled to compensation for your injury even if you believe that you may be partly to blame. Ohio negligence law permits a person to recover a portion of their damages in certain defined situations even though that person is partially at fault for causing the injury. If you feel that you may have a legal claim against another person or entity, please call us to discuss your case. The initial consultation is free. Representation will be accepted on a contingency fee basis if it is determined appropriate to pursue legal action on your behalf.

Several factors are considered in determining whether to pursue legal action, such as the ability to prove that another was wholly or partially responsible for your injury and the nature and the extent of the injury sustained. In pursuing your personal injury claim, we will retain and work with experts in various fields to fully develop the liability and medical aspects of your claim. We also help you navigate through the maze of paperwork that is often necessary when dealing with healthcare insurers and Medicare/Medicaid who have paid for treatment caused by another's wrongdoing.

If you feel that you have been injured due to the wrongdoing of another please call us at 216-621-8700. However, there are several things you can do right away to increase your chances of recovery.

This includes:
  1. Getting the names and addresses of all persons and entities you believe may be responsible for your injuries.

  2. Writing down, as soon as possible, as much information concerning the accident or injury.

  3. Detail in writing any conversations you had with persons involved in the accident or injury or any conversations you may have overheard involving those persons.

  4. Taking photographs of the scene of the accident, the cars or objects involved in the accident or injury and the injuries sustained.

  5. Preserve any evidence you may have tending to show who is at fault for the accident or injury.

  6. Identifying and writing down the names, addresses and phone numbers of witnesses to the accident or injury.

  7. Keeping a daily diary of how the injury has affected you, such as pain, inability to work, inability to engage in normal activities, medical treatment and emotional distress.
Please note that there are laws that limit the time you have to commence legal action to recover for personal injury. This time period may be as short as one year from the date of your injury. Because of the time limits imposed under state and federal law for the filing of personal injury actions, meeting with an attorney sooner rather than later is always recommended.
