Workers' Compensation
Workers' Compensation laws came into existence in America in the early part of the twentieth century. Before their enactment, injured workers could sue their employers for personal injury. The problem was by the time an injured worker could prove his or her case in court, often times, due to a lack of income when the injury prevented the worker from working, the household took a tremendous financial loss, and sometimes workers lost their homes. From the employer's point of view, work injury cases could expose companies to large verdicts.
The new law was intended to provide mutual benefit for both the injured worker and the employer. First, the injured worker would receive faster decisions on claims and benefits sooner. Secondly, the employer would not be exposed to huge jury verdicts. Instead, benefits would be computable under the law's formulas and, hence, the actual loss to companies would be far more predictable.
However, laws also evolve and are changed. Workers' Compensation has become a complex area of law, and an area that is given a great deal of attention by the business community. It can be overwhelming to try to understand what rights an injured worker may have, especially when he or she is recuperating from injuries.
